1. Scope of Application
These General Terms and Conditions (GTC) apply to all transactions concluded between Kligg (by Snatch Co. AG) and the customer. This includes both on-site purchases at the customer’s premises and online orders via our website. By confirming an order, the customer accepts the terms and conditions of these T
Deviating terms and conditions of the customer or additional agreements require the express written consent of Kligg.
2. Products and Services
2.1 Software License and Use
Description: The software products include one-pagers, information pages and the booking tool. These software solutions are delivered individualized and fully furnished according to the customer’s specifications.
Support: For Pro products, one year of technical support is included, starting from the date of order confirmation. Support includes technical malfunctions and adjustments within the scope of the original order.
Duration: The software remains active even after the end of the support period without incurring additional costs. Termination of use is not required. If desired, the software can be deactivated or deleted. A written notification is required for this.
2.2 Hardware
Description: Physical products (e.g. QR code/NFC stand) will be handed over to the customer after full payment.
Transfer of ownership: After full payment, all physical products become the property of the customer.
Responsibility: After handover, the responsibility for the use, care or disposal of the products lies with the customer.
Return: A return is only possible if the products have not been individualized (see point 6).
2.3 Additional services
Additional services that are not expressly part of the order (e.g. consulting services) are subject to separate agreements. These services are discussed individually and recorded in writing before they are carried out.
2.4 Coupon Ads
Booking: Companies can book exclusive coupons through Kligg, which are created and provided specifically for our platform. These coupons are used to promote offers and discounts and are published exclusively through Kligg.
Provision of data: The customer is obliged to provide the required data completely and correctly. These include:
•Title and description of the coupon
•Validity period
•Conditions to be fulfilled
•Additional information such as images or logos, if applicable
Kligg reserves the right to reject incomplete or unclear information before publication.
Exclusiveness: The coupons published on Kligg are exclusive and may not be offered simultaneously in the same or similar form on other platforms, unless expressly authorized by Kligg in writing.
Publication: Coupons will only be published after full payment of the agreed amount. After receipt of payment, the coupons are usually activated on the Kligg platform within 1-2 working days.
Responsibility: The customer is responsible for the content of the coupon and its compliance with applicable law (e.g. advertising law, competition law). Kligg assumes no liability for legal violations caused by the coupon content.
Changes and cancellations: After the publication of the coupon, changes are only possible in exceptional cases and after prior consultation with Kligg. Cancellation is excluded after publication.
3. Ordering and Conclusion of Contract
3.1 On-site at the customer’s site
On-site orders are taken by our Digital Growth Consultants. The customer confirms the order verbally or in writing. After completing the order, the customer receives a binding order confirmation by e-mail.
3.2 Online Orders
In the case of online orders, the contract becomes effective with the transmission of the order confirmation.
3.3 One-time payment and subscription models
For all products for which a subscription model is not expressly offered, there are no ongoing fees or monthly costs. These products are purchased by the customer once at a fixed price and can be used without restriction and for life. Termination is not required.
If a product is offered as a subscription model, there are ongoing costs. However, the customer is expressly informed in advance that this is a subscription model, including the corresponding conditions (e.g. term, fees).
For all other products (both software and hardware) that are not defined as a subscription model, the following applies: They are paid once, become the property of the customer in full and are available to the customer for unrestricted use.
4. Terms of payment
4.1 Payment methods
On-site at the customer’s premises: payment by invoice with a payment deadline of 10 days from the date of invoice. Alternatively, you can pay on site by credit card, PayPal or Twint.
Online orders: Payment is made exclusively by credit card, PayPal or Twint. Payment is due immediately upon ordering.
4.2 Retention of title
Ownership of physical products (e.g. QR code/NFC stand) will only pass to the customer after full payment of the agreed invoice amount.
For software products, the following applies: After full payment, the customer acquires the unrestricted right of use in accordance with the conditions specified in the order confirmation. However, software solutions remain legally the property of Kligg (by Snatch Co. AG), while the customer is granted a lifelong, non-transferable right of use.
Until full payment has been made, Kligg (by Snatch Co. AG) reserves the right to withhold the delivery of products and the activation of services.
5. Delivery and delivery times
Delivery times are based on the shipping conditions and are usually 1-2 working days. Delays due to force majeure or unforeseen circumstances (e.g. supply bottlenecks) do not lead to claims for damages by the customer.
6. Return Policy
6.1 Products without customization
For products that do not include customization (e.g. hardware without specific links or adjustments), we grant a 30-day right of return from receipt of the goods.
Requirements: The product is in its original condition and packaging. No individual adjustments have been made.
6.2 Exclusion from the right of return
Products with customizations are excluded from return. These include:
One-pagers, info pages and booking tools. Individualized products QR code/NFC stands that have been linked to specific links.
7. Liability and warranty
7.1 Software
We ensure the functionality of the software in accordance with the order. Errors caused by improper use, manipulation or external influences on the part of the customer are excluded from the warranty.
Our team undertakes to promptly address any technical malfunctions or failures that affect the use of the Software or the accessibility of the Services. However, the customer is not entitled to damages or other compensation due to such failures.
Kligg (by Snatch Co. AG) strives to resolve failures as quickly as possible in order to restore the full functionality of the software.
7.2 Hardware
Warranty covers material and production defects within 12 months from the date of purchase.
7.3 Disclaimer
Kligg (by Snatch Co. AG) shall not be liable for any indirect, consequential, lost profits, loss of use, business interruption or loss of data arising from the use of the products or services we provide.
Liability is excluded in particular for:
• Damage caused by improper use, operating errors, unauthorized interventions or manipulations of our products or software solutions by the customer or third parties.
• Failures or disruptions caused by external factors such as network problems, server failures, power failures or other circumstances beyond Kligg’s control.
• Damage caused by delays in the delivery or restoration of services, unless such delays are due to gross negligence or intent on our part.
• Damages resulting from loss of data, insofar as these are not due to gross negligence or intent on the part of Kligg.
Liability for slight negligence is excluded to the extent permitted by law. In cases of gross negligence or intent, liability is limited to the direct damage that can be proven to have been caused by Kligg and is limited to the amount of the order in question.
Our products and services are provided to the best of our knowledge. Nevertheless, no guarantee can be given for uninterrupted availability, complete freedom from errors or complete compatibility with all end devices, systems or third-party platforms.
8. Revocation and cancellation
8.1 Right of withdrawal
The customer has the right to withdraw from the contract within 30 days without giving any reason, provided that the products in question have not been individualized or specially adapted to the customer’s requirements. The withdrawal period begins on the day on which the customer has received the goods.
In order to exercise the right of withdrawal, the customer must contact Kligg (by Snatch Co. AG) in writing by e-mail or post and make a clear statement that he wishes to withdraw from the contract.
The return of the products is mandatory and must be made within 14 days of notification of the withdrawal. The products must be returned unused, undamaged and in their original packaging. The costs for the return shipment are borne by the customer, unless there is an error on the part of Kligg.
8.2 Exclusion of the right of withdrawal
The right of withdrawal is excluded for:
8.3 Cancellation Policy
Cancellation of orders is only possible if the processing or customization of the products has not yet begun. Once work has started on the creation of individualized products or services (e.g., one-pagers, QR code designs), cancellation is no longer possible.
For non-individualized products, cancellation can be made by written notice. In this case, goods that have already been shipped must also be returned within 14 days.
8.4 Refund
After successful inspection of the returned products, the purchase price minus shipping costs will be refunded to the account indicated by the customer within 14 days. In the event of damage or signs of use to the returned products, Kligg reserves the right to withhold a reasonable amount for the depreciation.

9. Final Provisions
Applicable law: Swiss law applies.
Place of jurisdiction: The place of jurisdiction is Biel/Bienne.
Changes to the T Kligg reserves the right to change these T at any time. Changes are effective from the date of publication on the website and affect existing contracts only after the customer’s consent.
