1. Scope

These Terms of Service (“Terms”) govern the contractual relationship between Kligg (by Snatch Co. AG) (“Kligg”, “we”, “us”) and users (“User”, “you”) of the Kligg platform.

By creating an account, purchasing a subscription, or using any Kligg services, you agree to these Terms. Deviating terms require explicit written consent by Kligg.

2. Description of the Platform

Kligg is a creator-first monetization platform that enables users to sell products, services, digital goods, memberships, auctions, flash sales, and lead-based offers through a single link and integrated checkout.

2.1 Software Access

Kligg is provided as a cloud-based Software-as-a-Service (SaaS). Access is granted for the duration of an active subscription.

2.2 No Payment Processing Ownership

Payments are processed via third-party providers (e.g. Stripe). Kligg does not store full payment credentials and does not act as a merchant of record.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity occurring under your account.

4. Pricing, Subscriptions & Billing

Kligg operates on subscription-based plans unless explicitly stated otherwise. Pricing, features, and billing intervals are shown during checkout.

• Subscriptions renew automatically unless canceled.
• You may cancel at any time; access remains until the end of the billing period.
• Fees are non-refundable unless required by applicable law.

5. Affiliate Program

Kligg offers an affiliate program for eligible users. Affiliates earn commissions on referred paying users according to the conditions shown inside the affiliate dashboard.

• Commission starts once a referred user becomes a paying customer.
• Commissions are paid automatically on a recurring basis while the account remains active.
• Kligg reserves the right to suspend or terminate affiliate participation in case of abuse.

6. User Content & Responsibility

Users are fully responsible for all content, offers, products, and services published through their Kligg account.

• You must comply with all applicable laws and regulations.
• You must not sell illegal, misleading, or infringing content.
• Kligg may remove or restrict content that violates these Terms.

7. Availability & Support

Kligg aims for high availability but does not guarantee uninterrupted access. Maintenance, updates, or external dependencies may cause temporary downtime.

Support is provided according to the plan selected and within reasonable effort.

8. Limitation of Liability

To the maximum extent permitted by law, Kligg is not liable for:

• Indirect or consequential damages
• Loss of revenue, profit, or data
• Business interruptions
• Issues caused by third-party services or integrations

Liability is limited to the amount paid by the user to Kligg in the twelve (12) months preceding the claim.

9. Termination

Users may terminate their account at any time via the dashboard. Kligg may suspend or terminate accounts in case of violations of these Terms or applicable law.

10. Changes to the Terms

Kligg reserves the right to update these Terms. Changes become effective upon publication on the website. Continued use of the platform constitutes acceptance of the updated Terms.

11. Governing Law & Jurisdiction

These Terms are governed by Swiss law. The exclusive place of jurisdiction is Biel/Bienne, Switzerland.
